Classifying workers for your business as independent contractors or employees is critical to properly paying workers under the Fair Labor Standards Act and the Texas Pay Day Act.  Improper classifications can result in audits by the Texas Workforce Commission (TWC) and the Department of Labor. (DOL) Mistakes can be costly in payment of back wages, taxes and penalties. Legal liability for accidents and the employer liability under the law may turn on whether the worker was an independent contractor or an employee.
